Emerging Trends in Bankruptcy: Professionalism, Self-Representation, and Changes in the Law

On December 9, 2020, Congressional Democrats, including Elizabeth Warren (D-Mass.) and Jerrold Nadler (D-N.Y.), proposed sweeping legislation that would overhaul consumer bankruptcy law. The proposed changes generally make it easier for consumers to access the bankruptcy system and discharge their debts. Rick Shelby, Phelps Dunbar, will discuss several topics proposed in the Consumer Bankruptcy Reform Act of 2020 (CBRA), including the merging of chapter 7 and chapter 13 bankruptcy into a new chapter 10 bankruptcy and also discharging student loan debt. Additionally, Rick will discuss recent changes to the Bankruptcy Code included in the Coronavirus Aid, Relief, and Economic Security Act (the " CARES Act"), enacted on March 27, 2020, and the Consolidated Appropriation Act ("CAA"), enacted on December 27, 2020.

Jesse George, The Pro Bono Project, will discuss professionalism in the context of volunteering for The Pro Bono Project 's Bankruptcy Self-Help Resource Center, developed in concert with the United States Bankruptcy Court for the Eastern District of Louisiana, and launched in tandem with the court's new Electronic Self-Representation, or eSR, system. Topics will include the increasing prevalence of self-representation, the eSR system, and the difference between legal information and advice.
